## 19. APP STORE SPECIFIC TERMS
### 19.1 Apple App Store Terms
If you access Pro-Play through an iOS device via the Apple App Store:
**Agreement:**
- This Agreement is between you and Pro-Play, not Apple
- Apple is not a party to this Agreement
- Apple is a third-party beneficiary with right to enforce certain provisions
**License:**
- License is limited to a non-transferable license to use the App on Apple-branded products you own or control
- License is subject to Usage Rules in Apple Media Services Terms and Conditions
**Maintenance and Support:**
- Pro-Play is solely responsible for maintenance and support
- Apple has no obligation to provide maintenance or support
- Contact Pro-Play for all support requests
**Warranty:**
- Apple provides no warranty for the App
- To the extent any warranty cannot be disclaimed, Apple is not responsible
- Pro-Play is solely responsible for warranty claims
**Product Claims:**
- Pro-Play, not Apple, is responsible for:
- Product liability claims
- Claims that App fails to conform to legal/regulatory requirements
- Consumer protection or similar claims
**Intellectual Property:**
- Pro-Play, not Apple, is responsible for investigation, defense, and settlement of intellectual property infringement claims
**Third-Party Terms:**
- You must comply with third-party terms applicable to the App
**U.S. Government Users:**
- The App is "Commercial Item" as defined in 48 C.F.R. §2.101
- U.S. Government rights are as specified in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202

If you access Pro-Play through an Android device via Google Play Store:

- Google is not a party to this Agreement

- License is subject to Google Play Terms of Service
- You must comply with the then-current Google Play Terms of Service
**Google Obligations:**
- Google has no obligation or liability with respect to the App or this Agreement

For apps distributed through other app stores or platforms:
- Similar terms apply with the relevant app store provider substituted

- We, not the app store provider, are responsible for the App and content
### 19.4 In-App Purchases
**Through App Stores:**
- In-app subscriptions purchased through app stores are subject to the app store's terms
- Billing is handled by the app store
- Cancellation must be done through the app store
- Refund requests should be directed to the app store
**Direct Purchases:**
- Purchases made directly through our website are subject to these Terms
